Terms of Use for EnSofia Inc. Software Application
Acceptance of Terms
By using our EnSofia Inc. Sofia-GPT software application (“Application”), you agree to be bound by these Terms of Use, which also include the terms and conditions of the OpenAI API, found at https://www.openai.com/legal . Please read these terms carefully before using the Application.
License Grant
Subject to these Terms of Use, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Application for your personal, non-commercial purposes. Any use of the Application not expressly permitted by these Terms of Use is a breach of these Terms and may result in the termination of your access to the Application.
Restrictions
You may not:
- sublicense, sell, rent, lease, or otherwise transfer the Application or any rights granted herein;
- modify, adapt, reverse-engineer, decompile, disassemble, or create derivative works based on the Application;
- use the Application for any illegal, immoral, or unauthorized purposes;
- use the Application to infringe on any intellectual property rights, including those of OpenAI and its licensors;
- use the Application in a manner that violates any applicable laws, regulations, or third-party rights.
Intellectual Property
All rights, title, and interest in and to the Application, including any updates, modifications, and enhancements, are and will remain the exclusive property of EnSofia Inc. and its licensors, including OpenAI. The Application is protected by copyright, trademark, and other intellectual property laws.
Termination
We reserve the right, in our sole discretion, to terminate your access to the Application and these Terms of Use at any time, without notice. Upon termination, your license to use the Application will immediately cease.
Disclaimer of Warranties and Limitation of Liability
The Application is provided “as is” without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. In no event shall EnSofia Inc. or its licensors, including OpenAI, be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use of the Application.
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Changes to These Terms of Use
EnSofia Inc. reserves the right to modify these Terms of Use at any time. We will post any changes on our website. Your continued use of the Application following the posting of any changes to these Terms of Use constitutes acceptance of those changes.
